Terms & Conditions

Last Updated: September 9, 2026

Welcome to RoksolanaBaran.com.

These Terms & Conditions govern your use of this website and the purchase of photography services, photo tours, photography workshops, photo licenses, prints and other services offered by PE Baran Roksolana ("I", "me", "my", "we" or "the Organizer").

By using this website, submitting a booking request, making a payment, or participating in a photo tour or photography workshop, you confirm that you have read, understood and agreed to these Terms & Conditions.

Please read these Terms carefully before making a booking.

1. Website Use and Acceptance

By accessing and using this website, you agree to comply with these Terms & Conditions.

If you do not agree with these Terms, please do not use the website or purchase any products or services through it.

I reserve the right to update these Terms from time to time. The version applicable to your booking will generally be the version in effect at the time your booking is accepted, unless otherwise required by applicable law.

2. Intellectual Property and Copyright
2.1 Website Content

All photographs, videos, text, graphics, logos, designs, maps, itineraries, written materials and other content published on this website are the property of PE Baran Roksolana or are used with appropriate permission and are protected by applicable intellectual property and copyright laws. You may not copy, reproduce, download, modify, distribute, publish, sell, license or otherwise use any website content without prior written permission.

2.2 Photography Licenses

Where a photograph is purchased or licensed through the website, the purchaser receives only the rights expressly stated in the applicable license or agreement. Unless explicitly agreed otherwise in writing, purchasing a photograph does not transfer copyright or ownership of the image.

3. Photo Tours and Photography Workshops

Photo tours and workshops may include guided photography, outdoor activities, trekking, hiking, transportation, accommodation, meals, permits, local guides and/or other services, depending on the particular tour. The exact services included and excluded from each tour are specified on the relevant tour page, booking information and/or booking confirmation.

The specific conditions published for an individual tour form part of the agreement for that tour.

In case of a conflict between these general Terms & Conditions and specific written booking conditions provided for a particular tour, the specific tour conditions will apply to the extent permitted by applicable law.

4. Prices

Prices are stated on the relevant tour, workshop or product page.

For example, a tour may have the following pricing structure:

  • Photo Tour Price: USD 6,000

  • Single Room Supplement: USD 1,000

  • Non-Refundable Booking Deposit: USD 1,500

  • Payment in Full: 60 days before the starting date

Prices may differ between tours.

Unless explicitly stated otherwise, the tour price does not include international or domestic flights, visas, travel insurance, personal expenses, excess baggage, personal equipment, meals or services specifically listed as excluded from the tour.

I reserve the right to change prices for future bookings.

5. Booking, Invoicing and Payment
5.1 Booking Confirmation

Submitting a booking request does not automatically guarantee a place on a tour or workshop.

A booking is confirmed only after I have accepted the booking and the required deposit has been paid.

Once the booking is confirmed, I will provide the participant with an invoice or payment request containing the amount due and payment instructions.

5.2 Payment by Bank Transfer

For international bookings, payments are made by bank transfer to my business IBAN account, unless another payment method is specifically offered.

The invoice or payment request will include the necessary bank details, including the IBAN and any other information required to complete the transfer.

The participant is responsible for ensuring that the full amount due is received in accordance with the payment deadline.

Any bank fees, intermediary bank charges, currency conversion costs or other transaction fees associated with the transfer are the responsibility of the participant, unless otherwise agreed in writing.

A payment is considered received when the required amount has cleared into my account.

5.3 Deposit

A non-refundable deposit is required to secure a place on a photo tour or workshop where specified on the relevant tour page.

The deposit amount and payment deadline will be stated on the individual tour page or in the invoice.

The deposit is non-refundable if the participant cancels the booking for personal reasons, subject to any mandatory rights provided by applicable law.

5.4 Final Payment

The remaining balance must be paid by the deadline specified for the particular tour.

Unless otherwise stated, the final payment is due 60 days before the starting date of the tour.

If the final payment is not received by the deadline, I may treat the booking as cancelled by the participant and apply the applicable cancellation policy.

6. Cancellation by the Participant

Because photo tours involve advance commitments to accommodation, transportation, permits, guides and other third-party services, cancellation costs may increase significantly as the tour date approaches.

Unless different cancellation terms are stated for a particular tour, the following policy applies:

More than 60 days before the tour

The booking deposit remains non-refundable.

Any additional amount paid above the non-refundable deposit may be refunded, less any non-refundable costs already incurred on your behalf.

60–31 days before the tour

Cancellation may result in the loss of the deposit and additional non-refundable costs already committed for your booking.

Any refund will depend on the amounts that can reasonably be recovered from suppliers.

30 days or less before the tour

Payments may be non-refundable, because accommodation, transportation and other services may already have been fully committed and may no longer be recoverable.

Where possible, I may attempt to recover refundable amounts from suppliers or fill your place with another participant. Any amount recovered may be passed on to you after deduction of applicable costs and transaction fees.

These cancellation terms may be replaced by different terms specifically stated on an individual tour page or booking agreement.

7. Transfer of a Booking

If you are unable to attend, you may request to transfer your place to another person.

Any transfer is subject to my prior written approval and may be subject to:

  • availability;

  • visa or entry requirements;

  • accommodation arrangements;

  • transportation arrangements;

  • supplier restrictions; and

  • administrative costs.

A transfer is not guaranteed.

The original participant remains responsible for any outstanding amounts until the transfer has been formally accepted.

8. Cancellation by the Organizer

I reserve the right to cancel a tour or workshop when necessary, including where:

  • the minimum number of participants has not been reached;

  • accommodation, transportation, permits or other essential services become unavailable;

  • circumstances make the planned itinerary impossible or unsafe;

  • unavoidable and extraordinary circumstances occur;

  • serious weather or environmental conditions prevent safe operation;

  • government restrictions, border closures, travel restrictions or security conditions prevent the tour from taking place;

  • war, armed conflict, civil unrest, strikes, natural disasters, epidemics or other circumstances outside my reasonable control materially affect the tour.

Where I cancel a tour, I will notify participants as soon as reasonably possible.

Depending on the circumstances and applicable law, I may offer one or more of the following options:

  1. rescheduling the tour to a new date;

  2. transferring the booking to another available tour;

  3. providing a credit toward a future tour;

  4. providing a substitute or modified itinerary; or

  5. refunding amounts paid, less any deductions that are legally permitted.

Where applicable law requires a full refund, that right will not be limited by these Terms.

Unless otherwise required by applicable law, I will not be responsible for additional expenses incurred independently by the participant, including flights, visa fees, travel insurance, equipment purchases, accommodation booked separately, or other personal travel expenses.

Where a cancellation is caused by unavoidable and extraordinary circumstances, no additional compensation beyond any refund legally required will generally be payable.

9. Minimum Number of Participants

Some tours may require a minimum number of participants to operate.

If the minimum number is not reached, I may cancel or reschedule the tour.

Where a tour is cancelled for this reason, participants will be notified within a reasonable period and will receive the refund or alternative arrangement applicable under the booking terms and applicable law.

10. Changes to the Itinerary

Outdoor photography tours are inherently dependent on conditions on the ground.

The published itinerary is an intended itinerary and not an absolute guarantee that every location, activity or route will be available.

I reserve the right to modify:

  • the order of activities;

  • routes;

  • accommodation;

  • transportation;

  • photography locations;

  • hiking routes;

  • departure times;

  • meeting points;

  • activities; or

  • other elements of the itinerary

where reasonably necessary for safety, logistics, weather, local conditions, permits, road conditions, closures, transportation issues or other circumstances beyond my reasonable control.

I will make reasonable efforts to maintain the character and quality of the tour.

Where a material change is required, I will communicate it to participants as soon as reasonably practical.

11. Weather and Natural Conditions

Photography tours are outdoor activities and are inherently dependent on weather and environmental conditions.

Weather may include, without limitation:

  • rain;

  • snow;

  • fog;

  • strong wind;

  • storms;

  • extreme cold or heat;

  • cloud cover;

  • poor visibility;

  • dust or sandstorms;

  • changing light conditions;

  • flooding;

  • road closures;

  • avalanche risk;

  • rockfall;

  • landslides;

  • wildfires;

  • volcanic activity; and

  • other natural hazards.

No particular weather, sunrise, sunset, astronomical event, landscape condition, visibility, wildlife encounter or photographic result is guaranteed.

A tour will not normally be cancelled simply because the weather is not ideal for photography.

However, if conditions become unsafe, I may modify, postpone, shorten or cancel activities or change the itinerary.

Safety decisions made by the Organizer or local guides must be respected.

12. High Altitude and Extreme Environments

Some tours may take place at high or extreme elevations, including locations above 3,000–4,000 metres above sea level or other environments where altitude and environmental conditions may significantly affect the human body.

Participants acknowledge that high-altitude travel may involve risks including, but not limited to:

  • altitude sickness;

  • headache;

  • nausea;

  • dizziness;

  • fatigue;

  • dehydration;

  • shortness of breath;

  • reduced physical performance;

  • sleep disturbance;

  • acute mountain sickness;

  • more serious altitude-related medical conditions; and

  • the need to descend or seek medical assistance.

Participants are responsible for determining whether they are physically and medically capable of participating in a particular tour.

I may require a participant to stop an activity, descend, return to accommodation or seek medical assistance if I reasonably believe their safety is at risk.

In such circumstances, I may not be able to provide a refund for unused portions of the tour.

Participants should seek appropriate medical advice before booking tours involving high altitude, strenuous hiking or remote environments.

13. Physical Fitness and Outdoor Activities

Photo tours may involve:

  • hiking;

  • trekking;

  • walking over uneven terrain;

  • steep ascents and descents;

  • carrying personal photography equipment;

  • early-morning or nighttime activities;

  • long periods outdoors;

  • exposure to cold, heat, wind or sun;

  • remote locations;

  • limited access to medical facilities; and

  • physically demanding conditions.

Participants must honestly assess their own physical capabilities and inform me in advance of any relevant limitations that may affect safe participation.

The participant is responsible for bringing appropriate clothing, footwear, personal medication, equipment and other items reasonably required for the tour.

14. Health, Medical Conditions and Emergencies

Participants are responsible for informing themselves about the health risks associated with the destination and activities.

Where relevant, participants should obtain professional medical advice before travelling.

I am not a medical professional and cannot provide medical advice or determine whether a participant is medically fit to undertake a tour.

In the event of an emergency, I may contact local emergency services or other appropriate assistance on the participant's behalf.

Any costs associated with medical treatment, evacuation, additional accommodation, transportation or repatriation are the participant's responsibility unless otherwise covered by applicable law or insurance.

15. Travel Insurance

Comprehensive travel insurance is strongly recommended and may be required for participation in certain tours.

Participants should consider insurance covering, where appropriate:

  • trip cancellation;

  • trip interruption;

  • medical expenses;

  • emergency evacuation;

  • mountain rescue;

  • repatriation;

  • lost or stolen baggage;

  • photography equipment;

  • travel delays;

  • missed connections; and

  • other risks relevant to the specific destination and activities.

Participants are responsible for checking that their insurance covers the specific activities, destinations and altitudes included in their tour.

I am not responsible for losses that could have been covered by appropriate travel insurance.

16. Flights and Independent Travel Arrangements

Unless explicitly stated otherwise, international and domestic flights are not included in the tour price.

Participants are responsible for arranging and paying for their own flights and other independent travel arrangements.

I strongly recommend allowing sufficient time between independently booked flights and the start or end of the tour.

I am not responsible for costs arising from:

  • delayed or cancelled flights;

  • missed connections;

  • lost baggage;

  • airline schedule changes;

  • airline strikes;

  • airport closures;

  • immigration or customs delays; or

  • other circumstances relating to independently booked transportation.

Where I arrange transportation as part of the tour, that transportation may be provided by independent third-party suppliers.

17. Accommodation

Accommodation varies according to the destination and specific tour.

In remote locations, accommodation may be simple and may not meet the standards of conventional hotels.

Facilities may include limited:

  • heating;

  • hot water;

  • electricity;

  • internet;

  • bathroom facilities;

  • food options; or

  • other amenities.

Accommodation may be subject to local availability and operational conditions.

17.1 Single Rooms

A single room may be available for an additional fee ("Single Room Supplement").

The availability and price of a single room will be specified for each tour.

In some remote locations, villages or rural areas, single-room accommodation may not be available at all, even where a single-room supplement is normally offered for other parts of the tour.

In such circumstances, shared accommodation may be necessary.

18. Shared Rooms

If you choose shared accommodation at no additional cost, you agree that the room may need to be shared with another participant.

In remote destinations, it may not always be possible to guarantee that shared rooms will be separated by gender.

For example, it may be necessary for participants of different genders to share a room where suitable accommodation is limited.

Where this situation arises, I will communicate with the participants involved and make reasonable efforts to ensure that everyone is comfortable.

If a participant is not comfortable sharing a room with a participant of another gender and a separate room is available, an upgrade to a single room may be required.

Any additional cost for such an upgrade will normally be the responsibility of the participant requesting it.

In certain remote locations, however, no alternative accommodation may be available.

19. Remote and Developing Destinations

Some tours take place in remote areas where infrastructure and services may be limited.

Participants acknowledge that:

  • roads may be rough or unpaved;

  • transportation may be delayed;

  • accommodation may be basic;

  • internet and mobile coverage may be unavailable;

  • electricity may be unreliable;

  • medical facilities may be distant;

  • schedules may change;

  • local services may operate differently from those in the participant's home country.

Participants should be prepared for a degree of uncertainty and flexibility.

20. Third-Party Suppliers

Certain services may be provided by independent third parties, including:

  • hotels and guesthouses;

  • local guides;

  • drivers;

  • transport companies;

  • airlines;

  • restaurants;

  • park authorities;

  • permit providers;

  • boat operators; and

  • other local suppliers.

I will make reasonable efforts to select reliable suppliers, but I cannot guarantee that third-party services will always operate without interruption or change.

Where appropriate, the terms and conditions of the relevant third-party supplier may also apply.

21. Participant Responsibilities

Participants agree to:

  • follow reasonable instructions from the Organizer and local guides;

  • comply with local laws and regulations;

  • respect local communities, cultures and customs;

  • respect wildlife and protected environments;

  • follow safety instructions;

  • remain with the group where required;

  • use appropriate equipment and clothing;

  • inform the Organizer of relevant limitations that may affect participation;

  • arrive at agreed meeting points on time; and

  • behave respectfully toward other participants, guides and local service providers.

I reserve the right to remove a participant from a tour where their behaviour creates a significant safety risk, threatens or harasses another person, damages property, seriously disrupts the group or violates local laws.

In such circumstances, no refund for unused portions of the tour will generally be provided, subject to applicable law.

22. Photography Equipment

Participants are responsible for their own photography equipment and personal belongings.

I am not responsible for loss, theft or damage to cameras, lenses, tripods, drones, computers, phones or other personal equipment, except where liability cannot legally be excluded.

Participants should ensure that their insurance covers their equipment.

23. Photography Results

Photography is affected by factors outside anyone's control.

I do not guarantee:

  • specific sunrise or sunset conditions;

  • Milky Way or other astronomical visibility;

  • aurora;

  • particular cloud formations;

  • wildlife encounters;

  • specific colours or light;

  • access to a particular viewpoint;

  • a particular number of photographs;

  • or any particular photographic result.

The purpose of a photo tour is to provide an experience, guidance and opportunities for photography rather than to guarantee specific images.

24. Safety and Risk

Participation in an outdoor photography tour involves inherent risks.

These may include, without limitation:

  • falls;

  • slips;

  • trips;

  • injuries;

  • altitude;

  • extreme weather;

  • road and vehicle accidents;

  • remote terrain;

  • rockfall;

  • avalanches;

  • water-related hazards;

  • wildlife;

  • insects;

  • illness;

  • food-related illness;

  • theft;

  • political or civil disturbances;

  • natural disasters;

  • limited emergency access; and

  • other risks associated with travel and outdoor activities.

Participants voluntarily accept the ordinary risks associated with the activities they choose to undertake.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

25. Passports, Visas and Entry Requirements

Participants are solely responsible for ensuring that they have:

  • a valid passport;

  • required visas;

  • permits;

  • vaccinations or health documentation where required;

  • sufficient validity on travel documents; and

  • any other documents required to enter or travel within the destination country.

I may provide general information about travel requirements, but participants should verify requirements with the relevant authorities before travelling.

I am not responsible for losses caused by a participant's failure to obtain the required documentation.

26. Personal Expenses

Unless specifically included in the tour price, participants are responsible for their own:

  • flights;

  • visas;

  • travel insurance;

  • meals and drinks not included in the itinerary;

  • personal purchases;

  • laundry;

  • excess baggage;

  • equipment;

  • medical expenses;

  • emergency transportation;

  • additional accommodation;

  • communication costs; and

  • other personal expenses.

27. Complaints

If you experience a problem during a tour, please inform me or the relevant local representative as soon as reasonably possible.

This gives me a reasonable opportunity to investigate the issue and, where possible, correct or mitigate the problem while the tour is taking place.

Complaints raised only after the tour may be more difficult to investigate or resolve.

Nothing in this section limits any rights you may have under applicable consumer or travel law.

28. Limitation of Liability

To the maximum extent permitted by applicable law, I will not be responsible for losses or damages arising from circumstances beyond my reasonable control, including but not limited to:

  • weather;

  • natural disasters;

  • war or armed conflict;

  • terrorism;

  • civil unrest;

  • strikes;

  • government restrictions;

  • border closures;

  • transportation disruptions;

  • third-party supplier failures;

  • road closures;

  • illness or injury;

  • lost or stolen personal property;

  • flight disruptions; or

  • other unavoidable and extraordinary circumstances.

Nothing in these Terms excludes or limits liability for matters that cannot legally be excluded or limited under applicable law.

29. Force Majeure / Unavoidable and Extraordinary Circumstances

For the purposes of these Terms, unavoidable and extraordinary circumstances may include events such as:

  • war or armed conflict;

  • serious security risks;

  • terrorism;

  • natural disasters;

  • earthquakes;

  • floods;

  • wildfires;

  • volcanic activity;

  • severe storms;

  • extreme weather;

  • significant public health emergencies;

  • government restrictions;

  • border closures;

  • strikes or major transport disruption; or

  • other circumstances beyond the reasonable control of the Organizer that materially affect the ability to perform the tour safely.

The existence and legal consequences of such circumstances will be assessed according to the circumstances of the individual tour and applicable law.

30. Photography, Video and Promotional Material

During tours and workshops, photographs or videos may occasionally be taken for documentary, portfolio or promotional purposes.

Where I intend to use identifiable images of participants for promotional purposes, I will seek appropriate permission where required by applicable law.

Participants may inform me before or during the tour if they do not wish to appear in promotional material.

31. Privacy

Personal information provided during booking or communication will be handled in accordance with the Privacy Policy available on this website.

By submitting a booking request, you acknowledge that certain information may need to be shared with relevant service providers where necessary to arrange the tour, such as accommodation providers, transport companies, guides or permit authorities.

32. Changes to These Terms

I may update these Terms & Conditions from time to time.

The updated version will be published on this website with a revised "Last Updated" date.

Changes will generally apply to future bookings and will not remove rights that have already arisen under an existing booking or under applicable law.

33. Applicable Law

These Terms shall be interpreted in accordance with the applicable laws governing the relevant transaction and the services provided.

Nothing in these Terms is intended to exclude mandatory consumer protection, travel or other legal rights that apply to a participant under the law applicable to their booking.

Where a particular tour is subject to mandatory travel or consumer protection legislation, those mandatory provisions will prevail over any conflicting provision of these Terms.

If you have any questions about these Terms & Conditions, a particular tour, booking or cancellation policy, please contact:

35. Art Prints – Orders and Payment
35.1 Orders by Inquiry

Art Prints are available by individual inquiry rather than through an automated online checkout.

To order a print, please submit an inquiry through the website or contact me directly.

Before accepting the order, I will confirm the selected artwork, size, format, price, production time and shipping cost.
An order is confirmed only after I have accepted the request and the required payment has been received.

35.2 Invoice and Payment

Once the details of the order have been confirmed, I will issue an invoice or payment request containing the total amount due and payment instructions.

For international orders, payment may be made by bank transfer to my business IBAN account, unless another payment method is specifically offered.

The invoice will include the relevant bank details, including the IBAN and any information required to complete the payment.

Any bank fees, intermediary bank charges, currency conversion costs or other transaction fees are the responsibility of the customer, unless otherwise agreed in writing.

Production of the print will begin after the required payment has been received.

35.3 Made-to-Order Prints

Each Art Print is produced individually and specifically for the customer's order.

Please carefully consider your choice of artwork, size and format before making payment.

Because the prints are made to order, an order generally cannot be cancelled or changed after production has started due to a change of mind or incorrect selection, except where otherwise required by applicable law.

35.4 Production and Shipping

Please allow approximately 3–7 business days for production before the print is dispatched.

Shipping is available internationally from Ukraine to most destinations, subject to postal availability, sanctions, customs restrictions, security considerations and other circumstances that may make delivery unavailable or impractical.

Shipping time depends on the destination country and selected delivery method and is additional to the production time.

Any customs duties, import taxes, VAT or other charges imposed by the destination country are the responsibility of the customer, unless otherwise stated.

35.5 Customs, Import Duties and Taxes

International orders may be subject to customs duties, import taxes, VAT, brokerage fees or other charges imposed by the destination country.

Unless expressly stated otherwise, all such charges are the responsibility of the customer.

The customer is responsible for understanding and complying with the import requirements of their country.

I cannot guarantee that a shipment will be exempt from customs duties, taxes or other charges.

35.6 Delivery Address

The customer is responsible for providing a complete and accurate delivery address, including the recipient's name, postal code, telephone number where required, and any other information necessary for delivery.

I am not responsible for delays, additional shipping costs or loss resulting from an incorrect or incomplete address provided by the customer.

If a package is returned because the customer provided an incorrect address, failed to collect the package, refused delivery or otherwise prevented delivery, additional shipping costs may apply before the order can be resent.

35.7 Damaged or Lost Prints

If an art print arrives damaged, the customer should contact me as soon as reasonably possible after delivery and provide photographs of:

  • the damaged print;

  • the packaging;

  • the shipping label; and

  • any visible damage to the package.

I will assess the situation and, where appropriate, work with the printing or shipping provider to arrange a replacement or other appropriate solution.

If an order is lost in transit, I will investigate the shipment with the relevant shipping provider.

The availability of a replacement or refund may depend on the shipping method, tracking information, insurance and the circumstances of the loss, subject to any rights the customer has under applicable law.

35.8 Returns and Refunds

Because art prints are produced specifically for each order, returns or refunds are generally not accepted for change of mind, incorrect size selection, colour preference or other reasons unrelated to a defect or shipping damage, to the extent permitted by applicable law.

This does not affect any statutory rights that cannot legally be excluded, including rights relating to defective, damaged or incorrectly supplied products.

If you believe that your print has a manufacturing defect or that you received an incorrect item, please contact me promptly after delivery so that I can investigate and, where appropriate, arrange a replacement or refund

35.9 Colour and Appearance

The appearance of a printed photograph may vary slightly from the image displayed on a screen.

Differences may occur due to:

  • monitor calibration;

  • screen brightness and settings;

  • colour profiles;

  • lighting conditions;

  • the characteristics of the selected paper or printing material; and

  • normal variations in the printing process.

Such minor variations do not necessarily constitute a defect.

35.10 Copyright and Ownership

Purchasing an art print does not transfer copyright or any intellectual property rights in the photograph.

All copyright and other intellectual property rights remain with PE Baran Roksolana, unless expressly agreed otherwise in writing.

The purchaser may display the physical print for personal purposes but may not reproduce, scan, digitally distribute, commercially exploit or create derivative works from the photograph without prior written permission.
